Appellate Court Affirms Judgment for Incapacitated Client

A friend of the firm, James Patrick Smith, and Tim Lee won a jury verdict in 2011 on behalf of a client who had allegedly signed a release after suffering a severe stroke. The probate court entered judgment on the jury’s verdict, finding that the client did not have the requisite mental capacity to enter the release, so was entitled to the funds her ex-husband had deposited years earlier following their divorce. Michelle Blair and Tim Lee defended the judgment on appeal. The Houston First Court of Appeals affirmed in In re Westbo, No. 01-14-00705-CV, and it unanimously denied the ex-husband’s request for rehearing en banc.
